Terms & Conditions
After initial contact, client will be asked to fill in a design brief to give a clear understanding of what work is required. White Lotus Design will then send a presentation to the client offering different options to find what best suits the clients’ budget and style. The presentation will be in the form of moodboards to give the client a visual representation of their options.
White Lotus Design agree to produce project materials at the request of the client, for fees agreed upon* in advance and delivery of the work by an agreed-upon deadline. White Lotus Design agree to create original work, which is free of plagiarism. White Lotus Design agree to cooperate with the client in the design process to ensure both parties are satisfied with the final project prior to completion and launch. White Lotus Design agree to take all client’s comments on board, but will also use their own skills and design knowledge to explore different approaches/routes throughout the design process.

White Lotus Design will offer two rounds of revisions (included in original quote), after initial design has been chosen. Honest, helpful feedback will be required from the client to help develop the finished design.
Any additional changes required after this will be charged at an hourly rate of £20 p/hr.
White Lotus Design acknowledge that they may receive or have access to information which relates to the client’s past, present, or future products, vendor lists, creative works, marketing strategies, pending projects/proposals, and other proprietary information. White Lotus Design agree to protect the confidentiality of the client’s proprietary information and all physical forms thereof, whether disclosed before this Agreement is signed or afterward.
The total cost of the project will depend on the requirements requested by the client, therefore each project will be priced differently, as the cost is determined by the estimated amount of time and details required to complete the job.
A 50% deposit is required upfront, after the design brief and budget have been established, and before any work begins. An invoice for this will be sent after the client agrees to these terms and conditions.
After the deposit is received, a receipt of this payment will be sent for the client’s records, and design work will begin.
This deposit acts as security for both White Lotus Design and the client, as it will secure the client’s project into the schedule and ensures the company are not at a loss for any work started.
The final balance is due towards completion of the project when the design has been approved. Only when the final payment has been received will any requested digital files be released. Only on this final payment will full rights to the design be transferred.

OWNERSHIP & RIGHTS
All preparation materials, sketches, visuals, including the electronic files used to create the project remain the property of White Lotus Design (unless any prior agreement has been made). The final artwork/digital files will become the property of the client mentioned in this proposal only upon final payment of the project.
Copyright in respect of any work commissioned in the course of the project will remain the property of White Lotus Design until it has been paid for in full.
If there are issues with the final payment, White Lotus Design then reserve the right to reuse/amend any of these ideas for other clients or to be used freely as concepts for portfolio.
Should the client attempt to use/modify/alter/replicate or steal any ideas without making agreed final payment, immediate legal action will be taken.
White Lotus Design reserves the right to show any artwork, ideas, sketches created for this project in a portfolio as examples of client work. This can be during the project and also on completion. If the client has any specific ‘secrecy/stealth mode’ requirements, they should mention this before agreeing to the proposal.
Final payment ensures that only the chosen final design becomes the client’s property*. Any previous ideas/concepts remain the property of White Lotus Design, unless any prior agreement has been made.
*Please see the Artwork Licensing section for any designs being used commericially.
If client requires artwork which will be used commercially, a licensing agreement will be made.
This agreement will state:
• what artwork is being licensed
• what products the artwork will be used on
• region where products will be sold
• time frame in which products will be sold
• the length of the licensing contract, usually 1-3 years (which can then be renewed or cancelled after time stated)
• royalty rates/fees
Please note the artwork will not be exclusive to the client and they also do not have full ownership. (White Lotus Design still retain all copyright and ownership of artwork and are free to license to other clients), unless prior agreement has been made.
Both parties understand that the client or White Lotus Design may terminate the service at any time if, for any reason, the relationship is deemed unsatisfactory by either party. Upon written or verbal cancellation, the client is responsible for payment for any work done towards the completion of the project based on the percentage of the project completed that is determined by White Lotus Design. Should the client cancel the project following its completion, they are then responsible for full payment as per the agreed upon estimate plus all expenses incurred. In the event of cancellation, White Lotus Design retain ownership of all copyrights and original work created.
